Terms of Service
Effective: September 20, 2026
This agreement is designed to remain workable as Nostali’s features and providers evolve while preserving rights that cannot be waived by law.
1. Agreement and operator
These Terms are a binding agreement between you and Extreme Retail Ltd., company number 516289774, 22 Brodetzky St., Tel Aviv, Israel (“Nostali”, “we”, “us” or “our”) governing Nostali’s websites, applications, AI processing, storage, sharing, Moments, subscriptions and purchases.
By creating an account, accepting, purchasing or using the Service, you agree to these Terms and the Privacy Policy. You must be at least 18 and legally able to contract.
2. The Service may change
Nostali helps digitize, organize, restore, edit, colorize, animate, share and create products from photographs and album pages. Features, providers, models, formats, limits, prices, Moments costs, rewards and availability may change, be tested, be discontinued or vary by account or location. We may use alternative providers or models.
Descriptions, previews, examples and delivery estimates are illustrative unless expressly stated otherwise at checkout. Beta or experimental features may be less reliable.
3. Accounts
Provide accurate information, maintain control of your email and report suspected unauthorized access. You are responsible for activity under your account and people you authorize. Accounts may not be sold or transferred without permission.
Guest files may exist only in that browser. Clearing data, changing devices or private browsing may remove them permanently. Verify account import before relying on cloud storage.
4. Your content and permissions
You retain ownership of your content and rights in created content. You grant us a worldwide, non-exclusive, royalty-free license to host, copy, transmit, adapt, process, generate outputs from and display it as reasonably necessary to operate, secure, support and improve the Service, fulfill requests, comply with law and enforce these Terms. It ends when content leaves active systems, subject to backups, legal retention and copies already shared.
You represent that you have all rights and permissions needed for the content and people depicted or described. You remain responsible for captions, family facts, prompts and sharing. Do not upload unlawful, infringing, deceptive, abusive, exploitative or non-consensual intimate content.
5. AI results and face detection
AI results are probabilistic and may be inaccurate, incomplete, distorted or similar to others’ output. They may invent features, colors, objects, backgrounds or motion. Preserve and compare the original. Results are not historical evidence, identity verification or professional advice.
Face detection proposes likely face locations, not identities. It can miss faces or mark non-faces. Nostali does not automatically recognize or match people; you are responsible for confirming each box and person association. We do not guarantee that a photograph can be repaired, that people remain recognizable or that output is unique or free of third-party claims.
6. Acceptable use
You may not violate law or rights; impersonate, harass, exploit or deceive; create non-consensual intimate imagery or sexual content involving minors; upload malware; bypass security or limits; scrape or reverse engineer except where law permits; interfere with the Service; resell access without permission; or present generated media as deceptive evidence or use it for unlawful biometric identification. We may investigate, remove, restrict, suspend or report conduct where reasonably necessary.
7. Moments, prices and failed processing
Moments are limited, non-transferable service credits with no cash value outside Nostali. The price and Moments cost at final confirmation control. Purchased, subscription and promotional Moments may have different disclosed conditions. Future prices and costs may change.
Kling video duration is currently 3–15 whole seconds, defaults to 5 seconds, and costs 3 Moments per second (9–45 Moments). Exact duration, cost and balance appear before submission. A final failed operation is designed to return its charged Moments. A disliked but technically completed result is not a failure; another generation may require payment.
8. Purchases, subscriptions and cancellation
Prices are shown before purchase, with taxes as stated. iCount and payment partners may handle payments and documents. A browser redirect does not prove payment; Moments are credited after server verification. For subscriptions, you authorize disclosed recurring charges until cancellation.
Cancel through account controls or email [email protected]. Subscription cancellation stops future renewal after confirmation and does not normally reverse Moments already delivered. Refunds, cancellation fees and timing follow the offer and applicable law, including mandatory Israeli consumer rights. Nothing limits a non-waivable right. Where lawful, we may charge the lesser permitted cancellation fee or deduct the lawful portion of a service already supplied at your request.
9. Sharing, downloads and physical products
Anyone holding a valid share link may access, forward, copy or download selected content. Revocation cannot recall copies already made. Share only when you have the right.
Physical products are available only when checkout shows the format, price, delivery, production and cancellation terms. Custom products may have limited cancellation rights after production begins, subject to mandatory law. Screen and print colors may differ.
10. Third-party services
The Service relies on hosting, storage, authentication, AI, video, payment, messaging and communication providers. Optional integrations may have separate terms. Providers, models and subprocessors may change. We are not responsible for services outside our reasonable control, without limiting responsibility that cannot lawfully be excluded.
11. Availability, suspension and termination
We may maintain, modify, suspend or discontinue the Service and restrict access for breach, security risk, non-payment, abuse, legal requirement, provider unavailability or operational necessity. Where practical, we will give notice and a reasonable export opportunity. You may stop and request deletion at any time.
Ownership, payment, disclaimers, liability, indemnity and dispute provisions survive as appropriate.
12. Disclaimers
To the maximum extent permitted by law, the Service is provided “as is” and “as available.” We do not promise uninterrupted availability, permanent storage, error-free or exact restoration, particular emotional or commercial value, or universal compatibility. Keep independent backups of irreplaceable originals and downloads. Mandatory warranties and consumer protections remain unaffected.
13. Liability and indemnity
To the maximum extent permitted by law, Nostali and its personnel/suppliers are not liable for indirect, incidental, special, consequential or punitive damages, lost profits, lost data or loss from forwarded share links. Aggregate liability will not exceed the greater of amounts paid during the previous 12 months or NIS 100.
Limits do not apply where prohibited, including fraud, willful misconduct, bodily injury or mandatory consumer/privacy rights. You will indemnify us against third-party claims from content or conduct violating these Terms or others’ rights, except to the extent caused by our breach or negligence.
14. Changes to these Terms
We may update these Terms for features, providers, pricing structures, risks, law or operations. We will post the date and provide additional notice where required. Material changes apply prospectively. Continued use after the effective date is acceptance where permitted; otherwise stop use and cancel renewal.
15. Governing law and contact
Israeli law governs, without conflict-of-law rules. Subject to mandatory venue or consumer rights, the competent courts of Tel Aviv–Jaffa have exclusive jurisdiction. Contact us before filing so we can try to resolve the issue.
